About 5 years ago I was receiving survivor benefits for both myself and my son from my husbands sudden death. I have since remarried but am now getting divorced and my current husband had me sign a prenuptial stating that if we split he would have zero financial obligation to us. Am I eligible to receive survivor benefits from my first husband again or is that terminated for good since I remarried? We do still receive benefits for my young son.Answer
First, pleace accept my condolences on the passing of your spouse. No matter how long ago I am sure this was very painful.
Secondly the “best” answer is to check with whomever was paying. I “assume” you mean social security but it could be a private policy.
If it is SS, and you get nothing if you are remarried. If you divorce, then you can get it again.
Without knowing the source of that income I can’t be more specific.
