Question for the Money Doctors

Question submitted on Oct 21, 2012.

Question

My Dad died in 2001 at age of 62. He was still working. My parents were married for 17 years but divorced in 1976. Right now my Mother is 70 yrs old - is she still entitled to my Dad''s SS?

Answer

Since your Mother was married to your Dad for more than 10 years and she is over 62 years old, she can receive benefits on Dad''s record if she is currently unmarried and your Dad would have been entitled to Social Security retirement. They will calculate the benefit based on the higher of her own work record or his work record.

Please make an appointment with the closest Social Security office to review this. If she was entitled to a higher benefit, she may get a retroactive payment.
